Selling on Amazon Spain: what to settle before launch

For a European brand, Spain is usually the third or fourth Amazon market, after Germany and France. Your account is already in place, because the same European seller account covers amazon.es. Three things make the difference: a Spanish EPR system with three registers across two ministries, a mandatory packaging representative for producers based outside Spain, and labelling in Spanish. This piece sets out what to settle before the first shipment.

Short answer

To sell on amazon.es you need: EPR registration numbers for packaging and, if you sell them, electronics and batteries; an authorised representative in Spain for packaging obligations; labelling and product information at least in Spanish; and, with stock in a Spanish warehouse, a Spanish VAT number. An EU-established company does not need a fiscal representative in Spain.

EPR in Spain: three registers, two ministries

Amazon.es collects EPR registration numbers for three categories: packaging, electrical and electronic equipment, and batteries. If a number is missing, Amazon says it may enrol you in its pay-on-your-behalf EPR service and deduct the fees from your account, and deactivate non-compliant listings (sell.amazon.es).

  • Packaging sits with the environment ministry (MITECO) under Royal Decree 1055/2022. A producer established in another EU member state must appoint an authorised representative in Spain (Art. 17(2)); if it does not and sells through a platform, the platform acts in its place as producer (Art. 2) (BOE, Royal Decree 1055/2022). On top comes membership of a collective scheme (SCRAP), the Spanish counterpart of Germany's dual system. A practical point: the registration number must appear on invoices (Art. 15(3)), and its absence tells the buyer that the supplier has not met its obligation (MITECO, packaging FAQ).
  • Electrical equipment is registered in RII-AEE, run by the Ministry of Industry. The obligation covers sellers established in other EU countries too, and registration is free (Ministry of Industry).
  • Batteries have a separate register, RII-PyA. Registration is free, but quarterly declarations of types and quantities placed on the market follow (Ministry of Industry).

Language: at least in Spanish

Spanish rules on labelling industrial products sold to consumers require the label information to be given at least in Spanish, visibly and legibly (BOE, Royal Decree 1468/1988). A translated listing on amazon.es is therefore only half the job; the label and the leaflet in the box are the other half.

VAT: shipping from home or stock in Spain

  • Shipping from your home country. Sales to Spanish consumers above the EU-wide 10,000 EUR annual threshold carry Spanish VAT, which you can declare at home through OSS.
  • Stock in a Spanish warehouse (FBA or Pan-EU). You need a Spanish VAT number and local returns. Only businesses established outside the EU must appoint a fiscal representative; an EU business registers and files itself (Agencia Tributaria).
  • The Canary Islands, Ceuta and Melilla are outside the EU VAT area (VAT Directive, Art. 6). Shipping there follows a different procedure from a sale to Madrid, so decide upfront whether you serve those addresses.

The order of steps

  1. Choose an authorised representative for packaging and sign with a collective scheme.
  2. If you sell electronics or batteries, apply to RII-AEE and RII-PyA.
  3. Enter the EPR numbers in the compliance portal of your seller account.
  4. Prepare labels, leaflets and listings in Spanish.
  5. Start by shipping from home with OSS; a Spanish warehouse means a Spanish VAT number first.
  6. Decide who answers Spanish customers and handles returns.

Which EPR numbers does Amazon require in Spain?

Does a company from another EU country need a representative in Spain?
